Public Place By-law 2025 & Regulatory Impact Statement
Public comments are invited for the proposed Public Places by-law 2025. The objectives of the by-law are:
The objectives of the By-law are:
- To establish controls on the use of Council reserves, parks, sports grounds, stadiums, boat ramps and other public buildings to protect these assets from damage;
- Regulate activities on Council land, facilities and reserves to protect the natural environment, public safety, wildlife and amenity of patrons and nearby residents;
- Enable access to public reserves to be closed or restricted; and
- Allow members of the public to hire public reserves and facilities for events or activities.
Potential Impact of the by-law
The by-law will regulate activities on public reserves owned or under the control of Council and where appropriate permits will be required for activities such as: public and sporting events, selling goods or services, busking, collecting money and alfresco dining associated with food businesses. Permit application fees will apply.
The by-law will provide Council with the power to:
- close or restrict access to reserves if necessary to protect public safety or the reserve from damage;
- apply controls for events, sport and commercial activities on public reserves and facilities. Including hire agreements and bonds.
- regulate activities that may impact on amenity, privacy, infrastructure, wildlife and the environmental conditions in public reserves;
- protect public safety by declaring liquor free areas, prohibiting playing golf, hunting or using projectiles in designated areas of reserves;
- prevent signs or structures being built or works occurring in public reserves, unless a permit is given;
- prohibit activities near children’s playgrounds;
- control the driving and parking of vehicles on public reserves ;
- specify areas where animals may or may be taken on public reserves; and
- Regulate activities in/on Council facilities, such as RV parking areas and boat ramps, including ‘rule of use’ for these facilities. User charges may apply for facility hire.
